The terms "we", "us", "our", and "Travelediary" refer to Tripediary Solution, while "you", or "your" pertains to the customer who visits our website and/or makes reservations through us.

Your use of this website is subject to your acceptance, without modification, of all the terms, conditions, and notices set forth below, collectively referred to as the "Terms of Use" or "Agreement." Please carefully read the Terms of Use. By accessing or using this website, booking any travel products or services, or contacting our call center agents, you agree to abide by the then-current Terms of Use. If you disagree with the Terms of Use, please refrain from using this website or making bookings through our call center agents. We may modify these Terms of Use, and your continued use of this website is contingent upon accepting the updated Terms of Use.

The services provided by us, as defined below, are exclusively available to you who have read and unconditionally accepted these General Terms and Conditions. To proceed with the booking process, acceptance must be confirmed by clicking on the appropriate box provided for this purpose. You agree to comply with all the obligations outlined in these terms and conditions. The agreement becomes effective once we send written confirmation of a booking to you via email.

You are considered to have read, comprehended, and agreed to the following terms. It is advisable for you to save and/or print a copy of these terms and conditions for future reference when making a booking.

ORDERS
Your purchases of travel offers are subject to the specific terms and conditions outlined in this agreement, along with any additional merchant-specific terms listed under the "Fine Print" of the offer and any specific terms and conditions of the 3rd party supplier.

Please note that the promotion of offers on the site is not considered a legally binding offer but rather an invitation to treat.

We retain the right to accept or reject your order at any time after it has been placed, with or without reason. This may occur due to factors such as the unavailability of a product or service, errors in pricing or product/service descriptions, or mistakes in your order. If we decide to cancel your order, you will receive a full refund for any payments made.

Once your order is placed, you are unable to cancel it, except as specified in this agreement.

PRICING
The default currency used on the website is Malaysian Ringgit (RM), and all prices displayed include taxes and charges where applicable unless otherwise stated. Some travel offers may require additional surcharges, which are payable directly to the hotel, and these will be mentioned in the relevant offer.

Please note that the prices of products and services shown on the website are current at the time of display. However, these prices are subject to potential changes caused by fluctuations in exchange rates, variations in other transport costs, adjustments in hotel rates, government taxes, and other related factors. As a result, we retain the right to modify prices accordingly without prior notice.

BOOKING FEE & PAYMENT
All bookings and purchases must be conducted in Malaysian Ringgit (RM) using either a credit card via a payment gateway or cash payment through bank transfer. We will proceed with the reservation upon receipt of your booking fee (please refer to the chart below for details), and all bookings are subject to hotel/tour availability. By paying the booking fee, you signify your agreement with our packages, prices, and terms & conditions. It's important to note that the booking fee is strictly non-refundable if the booking is cancelled.

The balance or full payment must be settled at least 30 days before the departure date. Failure to comply with this payment deadline may result in the automatic cancellation of your reservation and forfeiture of your booking fee. We cannot "hold" packages on your behalf if your payment is not received or is declined by your bank or credit card issuer. Please ensure timely and successful payment to secure your booking.

RESERVATION NAME
Reservations must be made under your name as it appears on your passport. Generally, name changes are not permitted. During the check-in process, you will be required to present your passport or ID. If the name on the reservation does not match the name on the passport or ID, you will be asked to create a new reservation to ensure compliance with the correct identification.

CONFIRMATION OF BOOKING
The confirmation of a booking will be sent to you via email and will contain essential details, including the description of the booked service and its price. It is explicitly agreed that the data stored in our information systems and/or its 3rd party supplier's system shall serve as evidence for the bookings made by you. Such data stored in computers or electronic media holds the same evidential value as a physical written document and is considered valid proof.

The booking confirmation:
1. Is only valid for the specific offer from the 3rd party supplier involved. It's essential to understand that the 3rd party supplier, not us, is the seller of the product and is solely responsible for honoring the package you purchased. While we make efforts to promote only reputable suppliers who provide excellent service, we cannot guarantee, warranty, or represent the standard of any product offered.
2. Cannot be exchanged for cash and cannot be combined with other gift certificates, packages, or promotions unless explicitly stated otherwise. They are also not valid with any other offer or on existing reservations. If there is any unused portion of the package, it is non-refundable and cannot be exchanged for other services or cash.

It is essential to keep your booking confirmation safe and ensuring that you can download, print, or access it is of utmost importance. We do not assume responsibility for lost or stolen booking confirmations due to your inability to obtain access or fraudulent use of the unique reference number associated with it.

PURCHASE EXPIRY AND EXTENSION
The booking confirmation is valid until the date specified on the travel booking confirmation. Any purchases that have expired, either partially or in full, are non-refundable. After expiration, the purchases become invalid and will not be honored accordingly.

If the booking includes a "book by" date, all reservations must be made before that specified date.

SUPPLIERS’ TERMS & CONDITIONS
Apart from any specific terms stated by us, the 3rd party supplier's Terms and Conditions will always be applicable. For example, if the 3rd party supplier is closed on specific days, the package will not be redeemable during those periods. Please be aware that refunds will not be provided if you are unable to use a package due to the 3rd party supplier's standard terms and conditions.

CONSECUTIVE DAYS
Unless the offer explicitly states otherwise, it is required to use the offers over 1 continuous period, and packages cannot be divided or split. For instance, if a package allows for 4 nights at a resort, those 4 nights must be used consecutively. You cannot use 2 nights during 1 period and then 2 nights during another. The usage must be continuous without any breaks or interruptions.

AMENDMENT & CANCELLATION
Amendment and/or cancellation of reservations must be made directly with us.

Amendment / Change of booking
If an amendment is requested after the booking has been confirmed, an amendment fee will be applied.

Bookings can be modified concerning the date of travel, the destination, the starting point of the trip, the accommodation, or the means of transport. However, these changes are subject to availability and may incur additional costs due to increases in hotel and other holiday-related expenses. If the amendment involves altering the departure date and/or the entire booking, it will be treated as a cancellation and be subject to the applicable cancellation terms and fees. To avoid any misunderstanding, cancellations must be communicated in writing. Any amendments cannot be made within 14 working days before the departure date.

Cancellation

We reserve the right to cancel a tour if there are insufficient passengers or if uncontrollable factors prevent the safe execution of the tour or the delivery of services as described in the itinerary. Such factors may include acts of God, war, transportation or labor strikes, civil unrest, pandemics, endemics, or orders from the Government of Malaysia and/or other countries.


In the event of tour cancellation, we will offer alternative tours, preferably to the same destination or similar tours. If you choose not to accept the alternative tour, we will make efforts to refund all payments made, subject to the refund policy of the 3rd party supplier. If the cancellation is due to insufficient passengers or the inability to secure accommodation, we will refund the amount you have paid.

Both we and the 3rd party supplier reserve the right to alter or modify the itineraries, travel arrangements, and hotel accommodations as necessary, with or without prior notice, in response to circumstances beyond our control. This may also include the withdrawal of the services of an accompanying tour manager.

If you decide to cancel your tour or travel booking and payment has been made, we will process a refund for your amount. However, please be aware that we will deduct any unrecoverable costs, which may include the booking fee as well as cancellation fees or expenses not retrievable from 3rd party supplier. These costs may encompass marketing, operational, financial, and other expenditures incurred in association with selling the package.


Refunds will not be granted for a no-show at the departure of the trip.

We reserve the right to cancel your booking if the payment is considered suspicious by the bank or if full payment is not received promptly.

Note: Kindly be aware that the cancellation policy may vary during high or peak seasons, including festive seasons, New Year, school holidays, national holidays, etc. Any specific variations will be communicated on a case-by-case basis.

REFUND POLICY
If a refund is due because of cancellation or changes to the booking, and it complies with the rules and restrictions specified during the booking process, we will process it accordingly.


The refund amount will be subject to the exchange rate at the time of the refund. Once we receive the refunds from the 3rd party supplier, the amount (after deducting any unrecoverable costs as mentioned under the cancellation clause) will be transferred back using the same payment mode used for the original booking. Please note that refunds from the 3rd party supplier may take up to 6 months.

Please be aware that no refunds will be provided for unused accommodation, meals, sightseeing tours, transportation, or other services included in the tour fares.

TRAVEL DOCUMENTS
Responsibility for ensuring that your travel documents, such as passports and essential visas, are in order, rests with you. To travel internationally, you must possess a passport or recognized travel document that remains valid for at least 6 months beyond your planned departure date from your final destination. If your passport has less than a year of validity remaining, it is advisable to check the destination's requirements before confirming your travel arrangements. The name on your passport must match the name on your ticket to avoid any potential travel restrictions and invalidation of insurance coverage.

Furthermore, it is your responsibility to obtain the necessary visas, vaccinations, and health certificates as required by the respective Government authorities of the countries you intend to visit. Requirements for visas and other travel documents may change, and it is essential to verify up-to-date information before making any bookings or departing on your journey. It is important to be aware that obtaining a visa may require sufficient time, so it is best to apply well in advance. The approval is solely at the discretion of the Immigration Department/Home Office of each country. We cannot be held responsible for any expenses, reimbursements, or tour price refunds if you are denied entry to any country on the tour for any reason, including a lack of necessary visas. For information regarding visa requirements, we recommend contacting the embassy of the country you intend to visit.

We are not liable if you are denied entry onto a flight or into any country due to your failure to carry the correct and adequate passport, visa, or other required travel documents mandated by airlines, authorities, or countries, including those you may be transiting through. This also includes all stopovers made by the aircraft, even if you do not disembark from the aircraft or leave the airport. If such an incident happens, the applicable cancellation charges, as specified in the cancellation charges table, will be enforced.

While most travels, including international trips, are completed without incident, some destinations may pose higher risks than others. We strongly advise you to review any travel prohibitions, warnings, announcements, and advisories issued by Wisma Putra before booking travel to international destinations. Being informed about potential risks can help ensure a safer and more enjoyable journey.

ADMINISTRATIVE & HEALTH REGULATIONS
It is your responsibility to ensure that you meet all foreign entry requirements and have all necessary travel documents, including passports and visas (for transit, business, tourist purposes, or otherwise) in order. We do not possess specific knowledge regarding foreign entry requirements or travel documents. We strongly urge you to thoroughly review travel prohibitions, warnings, announcements, and advisories issued by relevant governments before booking any international travel.


Health: Recommended vaccinations for travel may change at any time, and it is crucial to consult your doctor for the latest recommendations before your departure. You are responsible for obtaining the necessary vaccinations, adhering to prescribed medications, and following any medical advice related to your trip.

Disinfection: Countries reserve the right to disinfect aircraft if there is a perceived threat to public health, agriculture, or the environment. The World Health Organization and the International Civil Aviation Organization have approved 2 disinfection procedures: spraying the aircraft cabin with an aerosolized insecticide while passengers are on board or treating the aircraft's interior surfaces with a residual insecticide while passengers are not on board.

ACCOMMODATION SERVICES
Accommodation options may be provided separately or as part of a package holiday. These services are subject to the rules and restrictions set by the accommodation suppliers, which will be disclosed before making a booking. Such rules and restrictions may involve limitations, cancellation charges, and additional fees imposed by the 3rd party supplier.


For all hotel bookings, your credit cards will be charged in full upon reservation. The prices displayed on the website do not include any fees or charges for optional supplements, such as minibar snacks or telephone calls.

If you miss the check-in for the 1st night of the reservation but intend to check in for subsequent nights, it is vital to inform us of the reservation changes no later than the original check-in date. This step is necessary to avoid the cancellation of the entire reservation. Failure to confirm the reservation changes with us may result in the cancellation of the whole reservation, and any refunds will not be granted.

You are advised to take note of the cancellation policy period applicable to the hotel, which varies depending on the specific hotel, and to cancel or modify your reservation accordingly before the date of arrival. Failure to do so may lead to charges according to the rules and restrictions specified for the hotel reservation. Additionally, some hotels may have strict policies that do not permit changes or cancellations after a reservation is made, and these restrictions will be clearly outlined in the rules and restrictions for the hotel reservation.

Room bedding guide
Please note that, as a general rule, rooms are typically available for check-in starting at 15:00 (3:00 PM) and must be vacated by 11:00 (11:00 AM) on the day of departure, regardless of your arrival time, departure time, or mode of transportation.


Single rooms usually feature 1 bed, and there may be an additional supplement to be paid for these rooms. Double rooms typically have either 2 single beds or 1 double bed.

All prices listed on this website are based on the existing bedding arrangements in the room. If you have specific requests for room arrangements (e.g., twin share, separate beds, or additional rollaway beds), please make these requests at the time of booking. Depending on availability, such arrangements may be organized at the time of check-in, and any extra charges will be payable directly to the hotel. Additionally, it's important to be aware that certain rooms in hotels may have a maximum capacity limit.

Star ratings
Star ratings serve as a general guide; however, it is crucial to understand that they may not always reflect the official local rating and that standards can differ between hotels and accommodations within the same class in various countries, and even within the same country. Each country has its unique standards, meaning a 3 stars hotel in 1 country may not be equivalent to a 3 stars hotel in another country. It is essential to consider these variations while evaluating accommodation options.


Images
While we strive to ensure that property images and descriptions of amenities and facilities displayed on our website are accurate and up-to-date representations of the properties, we cannot guarantee this to be the case at all times, as we rely on information provided by our 3rd party supplier. These images and information are intended to give a general sense of the hotel's features.


Please be aware that the images depicting room types may not always represent the exact bed configuration of the room you are reserving. For example, a triple room in North America might be furnished with 1 double bed and 1 single bed, while in Asia, it could offer 1 double bed or 2 single beds, along with an additional rollaway bed. Furthermore, certain accommodations may impose an extra charge for supplementary beds or cots. It is essential to consider these variations when making your accommodation selections.

Activities
Occasionally, specific activities provided by the supplier, as mentioned in the accommodation description on the website, may be subject to cancellation due to factors beyond the supplier's reasonable control. These reasons could include adverse weather conditions, out-of-season stays, or insufficient participation to meet the required number of participants for the activity.


Regarding sightseeing arrangements, the sequence of various tourist attractions displayed is merely indicative and may be subject to change by the suppliers.

Meals
When meals are included in an accommodation package, the number of meals provided will be based on the number of overnight stays. The full board typically includes breakfast, lunch, and dinner. The half board usually includes breakfast and either lunch or dinner. The breakfast only usually meant for accommodation with daily breakfast only, depending on the specific package. For accommodations offering main meals, the service generally starts with dinner on the day of arrival and concludes with breakfast (for half board) or lunch (for full board) on the day of departure. If you are unable to consume 1 or more meals, no refunds will be issued.


Please be aware that, unless explicitly stated otherwise on the website, drinks are not included in the meals. If drinking water is unavailable, you will need to cover the cost of purchasing it themselves.

You are advised to bring special food for your baby along with them, as it may not always be available locally.

Taxes
In certain countries, the local authorities may enforce additional taxes, such as tourist tax, which are typically required to be paid directly at the location. It is solely your responsibility to settle these additional taxes. Please note that the amount of taxes may vary between the time of booking and the actual stay dates. We suggest considering travel insurance (if available) to safeguard against loss of deposits due to cancellation charges, baggage loss, medical expenses, and theft. However, we cannot guarantee or make representations about reimbursements. Therefore, it is essential to review the terms and conditions of your chosen insurance policy thoroughly. Your peace of mind during your travels is paramount, and having the right insurance coverage can provide added protection and security.

MEDICAL CONDITIONS, PREGNANCY, AND TRAVEL
Before traveling, especially if you have a medical condition or are pregnant, it is crucial to consult with your doctor, especially if your medical condition requires daily routine care, urgent attention, or if your pregnancy is considered high-risk. It is your responsibility to inform us about any relevant medical information at the time of booking. Consequently, you bear the responsibility for any risks, incidents, or consequences that may arise during your travel. RIGHT TO REJECT
We reserve the right to cancel or withdraw any itinerary or bookings made for you, as well as decline your participation or continue your membership in a tour if we have reasonable grounds to believe that your presence may pose a risk to the health, safety, or comfort of others on tour. In such instances, we may also need to cancel your reservation.


If, for any other reason, a carrier, hotel, or other supplier refuses to allow you to participate in the tours, our sole responsibility will be to provide a refund to you for any payments made. Please note that this refund may be subject to deductions for services already utilized, administration fees, cancellation charges, and any other applicable deductions as per the terms and conditions set forth by the 3rd party supplier.

Your safety and the well-being of all tour participants are of utmost importance to us. Therefore, we must adhere to these measures to ensure a smooth and secure travel experience for everyone involved.

RESPONSIBILITY
We act as an agent for travel and tour services to the mentioned destinations. Hotel rooms, activities, ground transport, and other services are provided by 3rd party suppliers, and we act on their behalf. While we endeavor to offer assistance whenever possible with your travel arrangements, we will not be liable for any changes made by these entities, and also any loss, inconveniences, or liabilities arising from the non-fulfillment or negligence of services provided by these 3rd party suppliers.


We want to assure you that we assume no responsibility for any direct or indirect loss, injury, or damage to you or your belongings. This is due to events beyond our control. These occurrences may include acts of God, government actions, declared or undeclared wars, threats of war, terrorist activities, civil unrest, strikes, riots, fires, thefts, robberies, epidemics, quarantine, customs or medical regulations, natural and nuclear disasters, technical or administrative transport issues, industrial disputes, airport closures, machinery or equipment breakdowns, and other unforeseeable situations. Neither ourselves nor any person or agent assisting you will be held liable for any loss, injury, damage, or delay that may occur during your program tour or holiday.

Please ensure the safekeeping of your travel documents throughout your journey as we cannot be legally liable for their loss. It is essential to know that we shall not be held responsible if you are deported or denied entry by Immigration Authorities. This is due to possessing unlawful items, improper travel documents, or actions deemed subversive by a foreign government. In such cases, no refund will be provided.

The ground package price is subject to currency fluctuations and ground cost increases. Any alterations or changes to your travel routing or dates are undertaken at your own risk. We will not be responsible for any inconvenience or additional expenses incurred as a result.

We reserve the right to modify itineraries, travel arrangements, and hotel accommodations, even after confirming in advance. While we retain the right to cancel or withdraw bookings made on your behalf, any booking fees paid by you will be promptly refunded.

During the tour, we may capture group photographs, and we reserve the right to use these pictures for commercial purposes.

EXCLUSION OF LIABILITY CLAUSE
We may provide information, software, products, and services that could include typographical errors. Wholesalers, hotels, and other suppliers offering services to us are considered independent contractors, not our agents or employees. Therefore, we are not liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of such persons. Additionally, we will not be liable for any personal injuries, death, property damage, or other damages or expenses resulting from acts or omissions by the aforementioned independent contractors.


We will not make any refund or compensation in the event of delays, cancellations, overbooking, strikes, force majeure, pandemics, endemics, or other causes beyond our direct control. We also assume no responsibility for any additional expenses, omissions, delays, re-routing, or acts of any Government or State authority.

In no event shall we and/or our suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of contract or in Tort, regardless of the cause of such damages.

FORCE MAJEURE
In this provision, a "Force Majeure Event" encompasses a range of acts, events, or causes beyond anyone's control, including but not limited to earthquakes, cyclones, floods, fires, storms, strikes, terrorist acts, civil disturbances, machinery breakages, or orders of governmental authorities. This definition also includes circumstances related to the novel coronavirus (COVID-19) that may impede the commencement, continuation, or completion of a trip.


If, due to a Force Majeure Event as defined above, your booking for tour packages or hotel accommodations is cancelled or rendered impossible to proceed, we will process a refund for your payment. However, please be aware that we will deduct any unrecoverable costs, which may include the booking fee as well as cancellation costs or expenses not retrievable from 3rd party supplier. These costs may encompass marketing, operational, financial, and other expenditures incurred in association with selling the package.

DISCLAIMER
We, our agents, and representatives disclaim responsibility and explicitly exclude liability for any injuries, illnesses, damages, losses, delays, accidents, or irregularities that may occur to a person or property during the bookings. All bookings are subject to the standard terms, conditions, and contracts of the respective owners or operators of the services involved.


We do not accept liability in contract or tort for any injuries, damages, losses, delays, additional expenses, or inconveniences caused directly or indirectly by events beyond our control or that are not preventable by reasonable diligence, including but not limited to war, civil disturbances, fire, floods, severe weather, acts of God, government or authority actions, accidents, equipment failures, or industrial actions.

Transportation companies shall be exempt from any liability concerning the detention, delay, loss, danger, sickness, or injury to passengers while not on board a carrier or conveyance operated by the transportation companies or firms.

We will advise and, if necessary, assist you regarding any claims against any party during your tour. We ensure that the collection, use, and disclosure of your data comply with the Personal Data Protection Act 2010 ('PDPA'). Your acknowledgment is noted that personal data collected and processed is obtained voluntarily and with your consent.
